4. Ad Submission. Uncle Henry's reserves the right to edit, refuse, delete, modify, or remove ads, postings, listings or messages in its sole discretion for any reason.

Uncle Henry’s doesn’t allow duplicate items to be submitted to different categories in our publication for free. Duplicate ads will be removed and your credits refunded. If you want the ability to submit duplicate ads, please submit both ads using the bold feature using your credits.

Uncle Henry's strictly prohibits the sale of illegal items (including, without limitation, counterfeit or stolen items).

Uncle Henry's does not guarantee continuous, uninterrupted or secure access to its web site. 9. Polls. At various times Uncle Henry's will conduct polls on its web site. These polls are conducted for entertainment purposes only. 10. Termination. Uncle Henry's reserves the right to terminate the publication of ads and/or accounts at any time for any reason upon refund, if applicable, of a pro rated portion of the price paid.

         Uncle Henry's reserves the right to determine commercial and private party/non-commercial ad(s) based on its own criterion. Uncle Henry's reserves the right to terminate any account, which has been inactive for a period of eighteen (18) months without refund of any amounts paid, credits earned.

         Uncle Henry’s does not offer refunds.

         If you terminate your subscription prior to the end of the subscription period, Uncle Henry's will issue a refund of purchase price on a pro rated basis.

         For purposes of determining the pro rated refund, Uncle Henry's will factor in time and credits.

         In doing this, Uncle Henry's will count every two (2) ad credits used as one week of any subscription period.

         The time period determined by the number of ad credits used will then be added to the actual time the account is open for a total time used on the account. Moreover, any part of one week will be counted as one week of subscription for purposes of any pro rated refund.

11. Rewards Program and Affiliate Program Benefits. In the event Uncle Henry’s offers an reward program: Rewards Program benefits balances totaling less than $30.00 may be used only as credit for on-site usage on Uncle Henry's web site. In no event shall any user be entitled to a refund, reimbursement, or "cash-out" for any Rewards Program benefits of less than $30.00. A recipient of Rewards Program benefits may "cash-out" any Rewards Program benefits totaling $30.00 or more. As used herein, "cash-out" means receive payment from Uncle Henry's in an amount equivalent to your benefits' cash value or the cash value of any part thereof if not cashing out all accrued benefits. Any partial cash-out will be subject to a $30.00 minimum. Affiliate Program benefits have no cash value. In no event shall any user be entitled to a refund, reimbursement, or "cash-out" for any Affiliate Program benefits. Affiliate Program benefits may be used only as credit for on-site usage on Uncle Henry's web site.

12. Prohibited Activities. By using Uncle Henry's web site you agree that any information provided by you (or any items listed) and your activities on the site shall not: (A) Be deemed offensive, indecent, or otherwise objectionable.

(B) Be false, inaccurate or misleading;

(C) be fraudulent or involve the sale of counterfeit or stolen items;

(D) Infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;

         (BB) you do not have a right to include. Moreover you shall comply with all applicable laws, statutes, ordinances and regulations regarding your use of our service and your listing, purchase and sale of items.

(O) United States military that have not been disposed off in accordance with the Department of Defense demilitarization policies.

(P) Controlled Substances or illegal drugs, prescription drugs, substances and items used to manufacture controlled substances and drug paraphernalia.

(Q) Blood, bodily fluids or body parts.

(R) Bulk email or mailing lists that contain names, address, telephone numbers, or other personal identifying information.

Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in Portland, Maine and judgment on the arbitration award may be entered into any court having jurisdiction thereof. Should either party file an action contrary to this provision, the other party may recover attorney's fees and costs.

This Agreement shall be governed in all respects by the laws of the State of Maine as such laws are applied to agreements entered into and to be performed entirely within Maine between Maine residents.
